Appeals & Revisions (Criminal)

Challenging convictions, seeking justice through the appellate system.

Overview

The criminal appellate system in Pakistan provides multiple tiers of review for those aggrieved by trial court decisions. Our firm handles the full spectrum of criminal appeals, including appeals against acquittal and conviction, criminal revisions, references to the High Court under Section 374 CrPC (death sentence confirmation), and petitions for leave to appeal to the Supreme Court of Pakistan under Article 185 of the Constitution. Our appellate practice is built on rigorous analysis of trial records, precise identification of legal errors, and persuasive written and oral advocacy.

Under the CrPC 1898, an appeal against conviction lies to the Session Court (for Magistrate decisions) or the High Court (for Session Court decisions) under Sections 410 and 411 CrPC. The High Court also exercises revisionary jurisdiction under Sections 435–439 CrPC, allowing it to examine the legality or propriety of any criminal proceeding for the purposes of satisfying itself as to the correctness, legality, or propriety of the finding, sentence, or order. The Supreme Court of Pakistan under Article 185 considers substantial questions of law of public importance in criminal appeals.

Our criminal appellate team has extensive experience in arguing before the appellate benches of all High Courts and the Criminal Appellate Jurisdiction of the Supreme Court. We specialize in appeals in capital punishment cases, where the stakes are the highest and the constitutional requirement of fair trial under Article 10-A demands the most exacting scrutiny. We also handle mercy petitions before the President of Pakistan under Article 45 of the Constitution for commutation of death sentences. Our approach combines meticulous record preparation with compelling appellate advocacy to secure justice for our clients.

Process & How We Help

1

Trial Record Review & Grounds Drafting

We obtain the certified copy of the trial court judgment, the deposition of witnesses, and the documentary evidence. We identify errors in appreciation of evidence, misapplication of law, procedural irregularities, and any violation of the right to fair trial.

2

Filing of Appeal & Stay

We prepare and file the memorandum of appeal with detailed grounds within the limitation period. Where the appellant is in custody, we apply for suspension of sentence and bail pending appeal under Section 426 CrPC.

3

Appellate Hearing

We prepare written briefs with indexed case law and present oral arguments before the appellate bench. We address each ground of appeal and respond to the respondent's contentions. In death sentence cases, we argue the reference under Section 374 CrPC.

4

Further Remedy & Finality

After the appellate judgment, we advise on further remedies including revision, review, or petition for leave to appeal to the Supreme Court. We pursue mercy petitions where executive clemency is appropriate.
