Frequently Asked Questions

A suit based on title requires the plaintiff to prove ownership through registered documents and revenue records. A suit based on prior possession (also called a possessory suit) only requires proof that the plaintiff was in possession and was dispossessed without consent or due process of law. The limitation period for a possessory suit under Section 9 of the Specific Relief Act 1877 is six months from dispossession.
