Overview

Habeas corpus — the right to challenge unlawful detention — is a fundamental safeguard against arbitrary State action. Under Article 199 of the Constitution of Pakistan 1973, the High Courts have the power to order the production of any person who is illegally or improperly detained. In cases of exceptional public importance, the Supreme Court exercises original jurisdiction under Article 184(3) for habeas corpus.
