Illegal Detention & Habeas Corpus
Freedom Must Be Lawful.
Overview
Habeas corpus — the right to challenge unlawful detention — is a fundamental safeguard against arbitrary State action. Under Article 199 of the Constitution of Pakistan 1973, the High Courts have the power to order the production of any person who is illegally or improperly detained. In cases of exceptional public importance, the Supreme Court exercises original jurisdiction under Article 184(3) for habeas corpus. Our firm acts promptly to file habeas corpus petitions for individuals detained without lawful authority.
Illegal detention can take many forms: arrest without lawful warrant, detention beyond the prescribed period without judicial remand, detention under preventive detention laws without proper justification, and enforced disappearances. Pakistan's legal framework, including the Code of Criminal Procedure 1898 and the Anti-Terrorism Act 1997, prescribes strict procedures for arrest and detention. Violation of these procedures renders the detention illegal and entitles the detained person to immediate release.
The Supreme Court of Pakistan has taken a particularly strong stance against enforced disappearances, issuing landmark judgments requiring the State to produce missing persons and prosecute perpetrators. We file habeas corpus petitions before the High Court and, where necessary, before the Supreme Court under Article 184(3). Our approach combines immediate legal action to secure production of the detainee, investigation into the circumstances, and claims for compensation.
